Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Skillstone website, mobile application, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

 

If you do not agree to these Terms, you must not use the Services.

1. About Skillstone

 

Skillstone is a professional, employer-managed learning and communication platform designed for workplace training, compliance, and organisational development.

 

Skillstone is not a public social networking service. Access to the platform is restricted to authorised users invited or provisioned by organisations.

2. Eligibility and Age Requirements
 

You must be at least 16 years of age to access or use the Services.

 

Skillstone is not intended for use by children. By using the Services, you represent that you meet the minimum age requirement.

 

Skillstone does not knowingly permit use of the Services by individuals under the age of 16. If we become aware that an account has been created or used in breach of this requirement, we may suspend or terminate access and remove associated data.

3. Accounts and Employer-Managed Access

User accounts are created, provisioned, and administered by organisations or authorised administrators.

 

Your access to the Services, including available features, content, and communication tools, is determined by your organisation’s configuration and policies.

 

Skillstone does not control employment decisions, workplace policies, or how organisations use the Services internally.

 

4. Acceptable Use

You agree to use the Services only for lawful, professional, and authorised purposes.

 

You must not:

  • Use the Services for unlawful, harmful, abusive, or deceptive activities

  • Upload or share content that is offensive, discriminatory, or inappropriate for a workplace environment

  • Attempt to gain unauthorised access to accounts, systems, or data

  • Use the Services in a way that interferes with platform security or functionality

 

Skillstone may suspend or restrict access where these Terms are breached.

5. Content and User Submissions

You retain ownership of content you submit to the Services.

 

By submitting content, you grant Skillstone a limited, non-exclusive licence to host, process, and display that content for the purpose of providing the Services to your organisation.

 

Organisations and authorised administrators may access submitted content in accordance with their configuration and policies.

6. Optional Communication Features

 

Skillstone may offer optional communication features, including messaging or chat, which are enabled or disabled at the discretion of the organisation administering the platform.

 

Where enabled, these features are intended solely for internal, professional communication between authorised users and are not public or social in nature.

 

Content and communications may be reviewed where reasonably necessary to:

 

  • Respond to support or safety reports

  • Enforce platform rules or organisational policies

  • Meet legal or regulatory obligations


7. Third-Party Services (Chat Integration)

 

Where enabled, chat functionality may be provided through a third-party service provider, CometChat.

 

Skillstone integrates CometChat as part of the platform. Use of chat features may be subject to CometChat’s terms and privacy practices in addition to these Terms.

 

Skillstone remains responsible for its obligations under applicable laws in connection with the Services, including where third-party providers are used.

8. Electronic Signatures

 

The Services may support electronic signatures for work-related documents as part of onboarding or other authorised organisational processes.

 

Electronic signatures are provided for document management and record-keeping purposes and are subject to organisational requirements and applicable laws.

9. Privacy and Data Protection

 

Skillstone collects and processes personal information in accordance with its Privacy Policy, which forms part of these Terms.

 

By using the Services, you acknowledge and agree to the collection and use of personal information as described in the Privacy Policy.


10. Intellectual Property

 

All Skillstone software, designs, branding, and platform content (excluding user-submitted content) are owned by or licensed to Skillstone.

 

You may not copy, modify, distribute, or reverse-engineer any part of the Services except as permitted by law.

11. Suspension and Termination

Skillstone may suspend or terminate access to the Services:

 

  • Where these Terms are breached

  • At the request of an organisation administering accounts

  • Where required to meet legal or regulatory obligations

 

Termination may result in loss of access to content, subject to organisational retention policies.

12. Disclaimers

The Services are provided “as is” and “as available”.

 

Skillstone does not guarantee uninterrupted or error-free operation and does not warrant that the Services will meet all organisational or user requirements.

13. Limitation of Liability

To the maximum extent permitted by law, Skillstone will not be liable for indirect, incidental, or consequential damages arising from use of the Services.

 

Nothing in these Terms limits liability where such limitation is not permitted by law.

14. Changes to These Terms

Skillstone may update these Terms from time to time. Updated Terms will be published on the website or within the Services.

 

Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of Australia, without regard to conflict of law principles.
